GENERAL PHOTOGRAPHY TERMS

1. About these terms
These terms apply to photography services supplied by Philip Lord, trading as PJL Photography (“PJL Photography”, “the photographer”, “I” or “me”).

These General Photography Terms should be read together with the service-specific terms for the client’s family, headshot or wedding booking and the booking confirmation.
If service-specific terms conflict with these General Photography Terms, the service-specific terms will apply to that booking.
2. Forming the agreement
A booking is not confirmed until:
PJL Photography has accepted the booking;
any required booking payment has been received; and
the client has accepted the applicable terms.
The booking confirmation will identify the service, price, date, location and main package inclusions.
The person making the booking confirms that they are at least 18 years old and authorised to make the booking.
3. Prices and payment
The total price and payment schedule will be shown on the relevant pricing page, booking form or written quotation.
Additional costs, including agreed travel, venue, parking, extended coverage or additional participants, will be disclosed and agreed before they are charged.
If an amount remains unpaid after its due date, PJL Photography may suspend planning, photography, editing or delivery until payment is received.
4. Consumer cancellation rights
Where a booking is made online, by telephone, by email or away from PJL Photography’s business premises, the client may have a statutory right to cancel within 14 days of entering into the contract.
To cancel during an applicable statutory cancellation period, the client should contact PJL Photography by email or through the website contact form and clearly state that they wish to cancel.
If the client asks PJL Photography to begin providing services during the cancellation period, the client may be required to pay a reasonable amount for services supplied before cancellation.
If the service is completed in full during the cancellation period following the client’s express request and acknowledgement, the statutory right to cancel may end once the service has been fully performed.
Nothing in these terms limits the client’s statutory consumer rights.
5. Cancellations outside a statutory cancellation period
If the client cancels after any applicable statutory cancellation period, PJL Photography may retain or charge an amount that reasonably reflects:
work already completed;
expenses already incurred;
the likelihood of filling the reserved date;
income directly lost because of the cancellation; and
costs saved by not completing the booking.
PJL Photography will not seek payment exceeding its reasonable net loss and will take reasonable steps to reduce that loss. Any cancellation calculation will avoid charging twice for the same loss.
Cancellation and rescheduling requests must be made in writing.
6. Cancellation by PJL Photography
If PJL Photography cannot provide the agreed service, the client will be offered a reasonable alternative date where appropriate.
If an alternative cannot be agreed, the client will receive a refund for services that have not been supplied.
Where appropriate, PJL Photography may offer a suitably experienced replacement photographer. The client is not required to accept a replacement.
7. Events outside either party’s control
Neither party will be responsible for delay or failure caused by circumstances that could not reasonably have been avoided, including severe weather, serious illness, venue closure, government restrictions or major transport disruption.
The parties will first try to reschedule the service. If rescheduling is not reasonably possible, the booking may be cancelled and payments will be dealt with according to the services already supplied, costs incurred and each party’s statutory rights.
8. Client responsibilities
The client is responsible for:
providing accurate booking and contact information;
arriving at the agreed place and time;
obtaining any necessary permission for participants, venues or private property;
informing PJL Photography about relevant access, safety or mobility requirements;
ensuring children are appropriately supervised; and
behaving safely and respectfully during the session.
PJL Photography may pause or end a session where continuing would create a significant safety concern, involve abusive behaviour or require unlawful activity.
9. Lateness and non-attendance
Late arrival may reduce the available photography time, particularly where another booking or venue restriction follows the session.
If the client does not attend and has not made reasonable efforts to contact PJL Photography, the booking may be treated as a client cancellation. Any sum retained will be limited to PJL Photography’s reasonable net loss.
10. Photographic style and creative control
The client confirms that they have reviewed PJL Photography’s portfolio and understand the photographer’s general style.
PJL Photography retains reasonable creative control over lighting, locations, composition, posing, image selection, cropping and editing.
Requests will be considered but particular poses, expressions, backgrounds, weather conditions or individual photographs cannot be guaranteed.
PJL Photography will not normally supply RAW, unedited or rejected files.
11. Delivery
Estimated delivery times are provided in good faith and may vary according to workload, technical requirements or circumstances outside PJL Photography’s reasonable control.
The client will be informed if a substantial delay becomes likely.
The client is responsible for downloading delivered digital images promptly and maintaining suitable backups.
PJL Photography is not required to store galleries or image files indefinitely. Unless otherwise agreed, files may be deleted 90 days after final delivery.
12. Prints and physical products
Prints and other products will be produced according to the specifications confirmed when ordered.
Colours and cropping may vary slightly between screens, printers, papers and materials.
PJL Photography remains responsible for addressing damaged, faulty, incorrectly supplied or undelivered products where required by law. The client should report an apparent problem promptly and provide photographs where reasonably requested.
This clause does not limit statutory rights concerning faulty or misdescribed products.
13. Copyright and permitted use
Copyright in photographs remains with PJL Photography unless expressly assigned in writing.
The client receives the usage rights described in the applicable service-specific terms. No ownership of copyright is transferred by supplying digital files or prints.
Images must not be sold, licensed to third parties, entered into commercial image libraries or used to promote an unrelated business without written permission.
Reasonable cropping for platform dimensions is permitted. Material editing, addition of filters, removal of signatures or watermarks, and alteration using artificial intelligence are not permitted without written approval.
14. Proof galleries and watermarks
Watermarked proof images are supplied only for viewing and selection.
Proof images must not be copied, downloaded, screenshotted, published, altered, subjected to watermark-removal software or used with artificial-intelligence editing tools.
Only finished images included in the client’s package or purchased separately are licensed for use.
15. Promotional use
PJL Photography will not rely solely on acceptance of these terms as permission to use identifiable client photographs for advertising.
Permission for portfolio, website, social-media, competition or promotional use will be requested separately. Refusing promotional permission will not affect the photography service supplied.
16. Image loss and technical failure
PJL Photography takes reasonable measures to safeguard image files.
If photographs are materially lost or damaged through technical failure before delivery, PJL Photography will offer an appropriate remedy, which may include a reshoot or a refund relating to the affected service.
Nothing in these terms excludes responsibility where it would be unlawful to do so.
17. Limits of responsibility
PJL Photography will provide its services with reasonable care and skill.
PJL Photography is not responsible for matters outside its reasonable control, including participants refusing to cooperate, restrictions imposed by a venue or poor conditions that the client elects to proceed in after being advised of the risk.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other responsibility that cannot lawfully be excluded.
18. Privacy
Personal information will be handled in accordance with the PJL Photography Privacy Policy:

19. Complaints
Any concern should be raised as soon as reasonably possible so that PJL Photography has an opportunity to investigate and propose an appropriate solution.

20. Governing law
These terms are governed by the law of England and Wales.
A consumer living elsewhere in the United Kingdom retains any mandatory protections provided by the law applicable to them.
Nothing in this clause prevents either party from using any court or dispute-resolution process available under applicable law.
